Self-Generation of Electricity – New Implementing Decree

The Government Council, which met on 23 October 2025 under the chairmanship of H.E. Mr. Aziz Akhannouch, adopted Decree No. 2.25.100. This decree sets the conditions for building and operating electricity self-generation installations, in accordance with articles 3 to 6 of Law No. 82-21.

The decree establishes three distinct procedures depending on the size and type of facility:

  • Declaration for small installations that are not connected to the electricity grid,
  • Grid-connection approval for medium-scale installations,
  • Authorisation for installations connected to the medium- or high-voltage electricity networks.

The text also explains the rules for operating these installations, connecting them to the grid, and the situations in which an authorisation may be withdrawn.

Although Law 82-21 was passed in 2023, several additional texts are still needed for full implementation, in addition to the decrees already in force. The government has postponed the review of Decree No. 2.25.01, which will decide whether producers may send more than 20% of their surplus electricity to the grid. Many consider the current limit too low to make projects profitable.

Two more texts are also expected. The first will regulate electricity storage, allowing self-producers either to use their own storage assets or to rely on services provided by grid operators. The second will address curtailment, a mechanism used to temporarily adjust generation to match demand.
